Advocacy Outside the Courtroom

Baum Hedlund Aristei & Goldman earned the distinguished honor from The National Law Journal and ALM Media of “Elite Trial Lawyers” first place winner two years in a row (2018-2019). In 2018, we received the award for our groundbreaking verdict in a high-profile generic Paxil suicide case against drug manufacturer GlaxoSmithKline. R. Brent Wisner, attorney and vice president of the firm, was also named “Titan of the Plaintiff’s Bar” by Law360 for his work on the case.

After obtaining a $289.2 million unanimous landmark verdict against Monsanto (now Bayer) in the summer of 2018 for causing a California man to develop non-Hodgkin lymphoma caused by exposure to Roundup weed killer, the National Trial Lawyers Top 100 awarded our trial team and co-counsel with “2019 Trial Team of the Year.” In addition, The National Law Journal and Trial Lawyer Magazine named trial attorney Brent Wisner, co-lead trial counsel on the Johnson case, one of “America’s Most Influential Trial Lawyers” and the Daily Journal recognized Brent in the “Daily Journal Top 100 Lawyers for 2018.”

Service and Fees

A Lawsuit Should be Filed Wherever Most Appropriate

It is important to decide in which state it is most advantageous to file the lawsuit, i.e., which state will allow the injured person or decedent’s family to obtain optimum compensation for their losses. Often a claim may be filed in one state which will apply another state’s damage laws. You should ensure your attorney is familiar with the multitude of states’ laws and choice of law rules, and is willing and able to conduct your case no matter where it is filed or which laws apply.

Statutes of limitations vary from state to state. A statute of limitations is the amount of time you have to file a personal injury or wrongful death claim/lawsuit, usually between one and three years, depending on the state, and usually much shorter if a governmental entity is involved. Because state law varies in every state, we stay abreast of the personal injury and wrongful death laws and statutes in every state. Baum, Hedlund, Aristei & Goldman has represented clients in every state in the United States and from countries on six continents.

If requested to represent a client in a state in which we are not licensed, we hire qualified local counsel to join our legal team at our own expense, without any additional cost to the client.

Attorneys’ Fees & Costs

Any initial consultation with our firm is free of charge. If we agree to accept your case, we work for a modest contingent fee percentage of the gross proceeds received through settlement or verdict. Our firm provides for all costs necessary to aggressively litigate each phase of the case. In all cases, if there is no recovery, no attorneys’ fees or costs are owed to our firm. Our fee percentage is almost always much less than other lawyers. We believe we are able to offer a relatively lower fee than most other attorneys because of the quantity of wrongful death and serious personal injury cases we handle nationally and the large amount, therefore, of similar work we have already done.
