Zantac Trial Schedule

Trial Alert: The first Zantac trial is scheduled to begin on February 13, 2023 in Oakland, California before Hon. Judge Evelio Grillo, Superior Court of California, Alameda County, Complex Litigation Department 21. This is the first of four bellwether trials in the California Zantac JCCP. Zantac attorneys R. Brent Wisner of Baum Hedlund and Jennifer Moore of Moore Law Group will serve as lead counsel at trial.

The makers of Zantac (ranitidine) are facing lawsuits alleging the widely-used heartburn medication causes several types of cancer. Zantac drug manufacturers named in lawsuits include:

  • GlaxoSmithKline
  • Sanofi
  • Pfizer
  • Boehringer Ingelheim

Most Zantac lawsuits are consolidated in a federal multidistrict litigation (“MDL”) before U.S. District Court Judge for the Southern District of Florida, the Honorable Robin L. Rosenberg.

The federal Zantac MDL is captioned 20-MD-2924-Rosenberg - In Re: Zantac (Ranitidine) Products Liability Litigation.

Zantac cases have also been filed in the following alternate jurisdictions to the MDL:

As of June 2021, certain Zantac cases can also be filed in California state court. Cases in California state court will be a part of the “Ranitidine Product Cases” Judicial Council Coordinated Proceedings (“JCCP”) 5150. The Honorable Evelio Grillo for the Superior Court of Alameda is the judge overseeing the Ranitidine Products Cases JCCP 5150 (also known simply as the California Zantac JCCP). Zantac MDL Trials and Updates | Federal Court Cases (Florida)

Judge Robin Rosenberg signed Pretrial Order #77 on May 12, 2022 outlining important Daubert dates upcoming in 2022:

September 20, 2022 – Hearing on Defendants’ Daubert motions/summary judgment motion. The time for each argument will be determined in a later Order. The parties should remain available on September 21 and September 22, should the Court conclude that it requires additional time.

September 28, 2022 – Hearing on Plaintiffs’ Daubert motions/summary judgment motion. The time for each argument will be determined in a later Order. The parties should remain available on September 29 and September 30, should the Court conclude that it requires additional time.

The parties will begin selecting cases for potential bellwether trials after the court rules on Daubert motions. We expect the first Zantac bellwether trial in the MDL to happen in mid-2023 or later.

Zantac JCCP Trials and Updates | California State Court Cases

Plaintiffs provided Plaintiff Profile Forms (PPFs) for 100 bellwether candidates that Defendants had chosen from a pool of approximately 700 California cases. That pool consisted of California residents (some are filed cases and others are pending) from Plaintiffs Liaison Counsel and Plaintiffs Executive Committee.

Then Defendants chose ten (10) bellwether trial candidates. The plaintiffs also selected ten (10) of their own bellwether California resident trial candidates. There are a total of 20 bellwether candidates (ten from the plaintiffs and ten from the defendants) that will undergo extensive discovery.

In March of 2022, the Plaintiffs and the Defendants selected four bellwether trial picks (for a total of eight). Each side had the opportunity to designate a pick from the other side. The remaining five (5) to six (6) bellwether trial picks were considered the bellwether trial pool. From the 5-6 picks, the pool was narrowed down to four total bellwether picks.

On June 21, 2022, Judge Evelio M. Grillo signed Pretrial Order #4, which established the following important dates for the California Zantac JCCP:

January 25, 2023 – Court hearing on Sargon, which allows the legal teams for the plaintiffs and the defendants to present their expert witnesses and educate the court on the science that underpins their arguments. After carefully considering the expert opinions, Judge Grillo will decide whether the experts used sound logic and valid methodologies to arrive at their scientific opinions. If Judge Grillo determines that the experts used valid methodologies, then Zantac cases in the JCCP can proceed to trial and the experts will be allowed to provide evidence and testimony on whether Zantac causes cancer, and whether that propensity for inducing cancer caused a particular Zantac user to develop cancer.

February 13, 2023 – If plaintiffs’ experts pass muster in Sargon, the first bellwether trial will begin. This could also be the first Zantac trial in the country. A bellwether trial is essentially a test case in a mass tort litigation that sets a precedent for the hundreds or thousands of cases making the same or similar allegations. The first bellwether trial will be a good indicator for out-of-court settlement resolutions. If the plaintiffs win a jury verdict, it generally increases the likelihood that cases will end in settlement agreements.

May 1, 2023 – Second Zantac bellwether trial in the California JCCP. Bellwether trials will continue unless a global settlement is reached, or the court appoints a mediator to negotiate resolutions.

August 7, 2023 – Third Zantac bellwether trial in the California JCCP.

October 23, 2023 – Fourth Zantac bellwether trial in the California JCCP.

Zantac Trial in Tennessee (Shelby County)

Zantac Trial in Texas (Nueces County)

When is the first Zantac Trial?

Based on Judge Grillo’s Pretrial Order #4 in the California Zantac JCCP, the first Zantac trial in the California JCCP is scheduled for February 13, 2023, before Judge Grillo for the Superior Court of Alameda.

The Zantac MDL will likely hold its first trial in mid-2023, according to Judge Rosenberg’s pretrial order #65. “The Court’s vision is that bellwether trials will be conducted within 9-12 months following Daubert rulings.” Daubert hearings are scheduled for September of 2022, which would put the first MDL trial sometime between June 2023 and August 2023.
