Our Successes

While the majority of commercial transportation cases and drug product liability cases settle before a trial is conducted, we at Baum, Hedlund, Aristei & Goldman always prepare each one of our cases as if it were going to trial. This has a great impact on the behavior of the defendants in settlement negotiations and trial.

Collectively, our attorneys, in their careers thus far, have conducted trials in more than 200 cases, including aviation disasters, truck accidents, pharmaceutical drug injuries and product liability.

Some clients prefer to have their case resolved before trial while others desire to see their case result in a trial. Regardless of the final outcome, we do what is in the best interests of our clients.

Our most recent truck accident trial was conducted in the U.S. District Court for the Northern District of Ohio, Eastern Division in Cleveland.  Our firm successfully brought to trial a commercial truck accident case against Tyson Foods, where our clients were awarded $7,028.687 for the loss of their son, a single young adult.  Tyson Foods disagreed with the verdict and asked the court for a new trial or reduction of the verdict as it is one of the largest verdicts for the death of an unmarried person in Ohio state’s history.  In October of 2007 the judge not only denied Tyson's request but based on the evidence and testimony presented by our firm at trial, the judge granted the plaintiffs prejudgment interest, increasing the total amount to be awarded the family.

The firm's most recent aviation trial which took place in Southern California and was a products liability trial against Bell Helicopter for a tail rotor failure in which we represented the families of three Los Angeles Fire Department paramedics who were killed in a rescue helicopter crash.  (Our firm successfully changed aviation product liability law in an earlier Appeals Court decision on this case.)  The case resolved during the third week of trial.

In 2003, we co-tried an aviation case in Los Angeles in which we represented the family of a 22 year-old woman who was killed in a charter jet Gulfstream III, operated by Avjet and owned by Airborne Charter Inc., carrying 15 passengers from Los Angeles to Aspen when it crashed about 2,400 feet short of the runway. Avjet Corp., reached an $11.7-million settlement with the families of three people killed in the crash. The settlement was reached as a Los Angeles jury was about to begin the punitive phase of the trial. Our clients settled for $9.5 million after the jury awarded them compensatory damages of $8.5 million.
